Terms & Conditions

Last updated: September 2026
‍
These Terms & Conditions apply to services provided by CassCaptures (“CassCaptures”, “we”, “us” or “our”). By accepting a quote, making a booking, paying an invoice or engaging CassCaptures to provide services, you agree to these Terms & Conditions.

1. Our Services

CassCaptures provides photography, videography, content creation, social media content and other creative and digital services.

The specific services, deliverables, pricing and timeframes for each project will be outlined in the relevant quote, proposal, package or agreement.

2. Quotes

Unless otherwise stated, all quotes are valid for 30 days from the date of issue.

Pricing is based on the information and scope provided at the time of quoting. Additional work, changes to the agreed scope or additional deliverables may incur extra charges.

3. Bookings & Acceptance

A project or service is considered accepted when the Client accepts a quote, signs an agreement, makes a required payment or otherwise confirms in writing that they wish to proceed.

Where a deposit or upfront payment is required, the booking may not be secured until payment has been received.

4. Payment

Payment terms will be specified on the relevant quote, invoice, proposal or agreement.

Unless alternative payment arrangements have been agreed in writing, invoices must be paid by the due date shown on the invoice.

For ongoing monthly services or subscriptions, the agreed payment schedule will apply.

Additional or one-off services will be invoiced separately where applicable.

CassCaptures reserves the right to pause work, withhold final content or suspend ongoing services where invoices are overdue.

5. Cancellations & Rescheduling

If you need to cancel or reschedule a booking, please provide as much notice as possible.

Deposits, booking fees and costs already incurred may be non-refundable.

Where significant work has already been completed before cancellation, CassCaptures may invoice the Client for work completed and expenses incurred up to the cancellation date.

Rescheduling is subject to availability.

6. Client Responsibilities

The Client is responsible for providing CassCaptures with the information, access, products, locations, approvals and other materials reasonably required to complete the agreed services.

The Client is also responsible for ensuring they have permission for CassCaptures to photograph or film at relevant locations and, where applicable, to feature people, products, branding or other materials supplied by the Client.

Delays in providing information, feedback or approvals may affect agreed delivery timeframes.

7. Content Delivery

CassCaptures will make reasonable efforts to deliver content within any estimated timeframe provided.

Delivery dates may be affected by the scope of work, Client feedback, weather, illness, equipment issues, events outside our reasonable control or other unforeseen circumstances.

Unless specifically agreed, delivery timeframes are estimates rather than guaranteed deadlines.

8. Revisions

The number of revisions included is two unless otherwise outlined in the relevant package, quote or agreement.

Additional revisions or changes outside the original scope may incur an additional fee.

Clients should provide clear and consolidated feedback wherever possible to avoid unnecessary additional revisions.

9. Ownership & Usage Rights

Once the relevant invoice has been paid in full, the Client may use the final approved content created by CassCaptures for their own personal or business purposes, including websites, social media, advertising, email marketing and print.

Where agreed as part of the service, the Client may also be provided with access to raw content.

Unless otherwise agreed in writing, the Client may not sell, sublicense, transfer or commercially license CassCaptures content to another party.

CassCaptures retains the right to display and use approved and published work for its own portfolio, website, social media, advertising and promotional purposes.

If content needs to remain confidential or must not be used by CassCaptures for promotional purposes, this must be agreed in writing before the content is created.

10. Raw Files

Raw photos, video footage, project files and other working files are not automatically included unless specified in the Client's package, quote or agreement.

Where raw content is included, it will be provided in the format available to CassCaptures and may not have undergone editing, colour correction, audio processing or other post-production.

11. Creative Direction

By engaging CassCaptures, the Client acknowledges that photography, videography and content creation are creative services.

While CassCaptures will work to the agreed brief and take reasonable account of the Client's preferences, creative decisions relating to filming, photography, editing, composition, colour, music, pacing and overall presentation may be made at CassCaptures' professional discretion.

12. Social Media & Third-Party Platforms

CassCaptures cannot guarantee the performance of content on social media or other digital platforms.

Results such as views, reach, engagement, followers, enquiries, leads or sales may be affected by algorithms, advertising budgets, market conditions, audience behaviour and other factors outside CassCaptures' control.

CassCaptures is not responsible for changes, outages, restrictions or account actions made by third-party platforms.

13. Music, Fonts & Third-Party Assets

Some content may include music, fonts, templates, stock assets or other materials provided or licensed by third parties.

The use of these materials may be subject to the relevant third party's licence terms and platform restrictions.

Where the Client supplies materials to CassCaptures, the Client confirms that they have the necessary rights or permission for those materials to be used.

14. Loss or Damage

CassCaptures takes reasonable care when capturing, storing and delivering content.

However, to the extent permitted by law, CassCaptures will not be liable for delays, loss or damage caused by circumstances outside our reasonable control, including equipment failure, data corruption, weather, venue restrictions, third-party platform issues or other unforeseen events.

Where CassCaptures is legally liable in connection with the services provided, our liability will, to the extent permitted by law, be limited to the amount paid by the Client for the affected service.

Nothing in these Terms & Conditions excludes or limits any rights or remedies that cannot legally be excluded under New Zealand law.

15. Website Use

The content, branding, photographs, videos, graphics and other materials displayed on the CassCaptures website are owned by or licensed to CassCaptures unless otherwise stated.

They may not be copied, reproduced, distributed or commercially used without prior written permission.

16. Privacy

Personal information collected through our website, enquiries, bookings and services will be handled in accordance with our Privacy Policy and applicable New Zealand privacy laws.

17. Changes to These Terms

CassCaptures may update these Terms & Conditions from time to time. The latest version will be published on our website.

For an existing confirmed project, the terms that applied when the project was accepted will continue to apply unless otherwise agreed in writing.

18. Governing Law

These Terms & Conditions are governed by the laws of New Zealand.

Any disputes relating to these Terms & Conditions or services provided by CassCaptures will be dealt with under New Zealand law.
